2. Vehicle Sales

2.1 Vehicle Condition

Unless otherwise stated in writing, all pre-owned vehicles are sold "AS IS" and "WITH ALL FAULTS" subject to applicable federal and state laws.

Customers acknowledge that:

• They have inspected the vehicle or had the opportunity to inspect the vehicle.

• Vehicle history reports may be available upon request.

• Cosmetic imperfections, normal wear and tear, and minor mechanical issues may exist in used vehicles.

2.2 Vehicle Descriptions

Merc Auto Center strives to provide accurate vehicle descriptions. However, errors regarding vehicle specifications, mileage, options, pricing, availability, or photographs may occur.

We reserve the right to:

• Correct any errors or omissions.

• Cancel transactions resulting from pricing errors.

• Update vehicle information without prior notice.

2.3 Vehicle Availability

Vehicle inventory is subject to prior sale and availability. A vehicle displayed online or advertised may no longer be available at the time of inquiry.

 

3. Deposits and Reservations

3.1 Vehicle Deposits

A deposit may be required to reserve a vehicle.

Unless otherwise agreed in writing:

• Deposits are non-refundable.

• Reserved vehicles will be held for the agreed reservation period.

• Failure to complete the purchase within the agreed timeframe may result in forfeiture of the deposit.

 

4. Financing

4.1 Financing Assistance

Merc Auto Center may assist customers in obtaining financing through third-party lenders.

Approval is subject to:

• Credit review

• Income verification

• Employment verification

• Lender requirements

Merc Auto Center does not guarantee financing approval.

4.2 Third-Party Agreements

Any financing agreement is between the customer and the lender. Merc Auto Center is not responsible for decisions, terms, rates, or actions of third-party financing institutions.

 

5. Trade-In Vehicles

Customers trading in vehicles represent and warrant that:

• They are the legal owner of the vehicle.

• The title is valid and transferable.

• Any known defects or liens have been disclosed.

Merc Auto Center reserves the right to revise trade-in valuations if undisclosed issues are discovered.

 

6. Vehicle Service and Repairs

6.1 Authorization

Customers authorize Merc Auto Center to perform requested repairs, maintenance, diagnostics, or inspections.

6.2 Estimates

Repair estimates are provided as approximations only.

Additional repairs may be necessary after inspection. We will make reasonable efforts to obtain customer approval before performing additional work.

6.3 Storage Fees

Vehicles left on the premises beyond the completion date may be subject to storage fees after reasonable notice to the customer.

6.4 Abandoned Vehicles

Vehicles not claimed within the time allowed by applicable state law may be considered abandoned and handled according to applicable regulations.

 

7. Warranty Disclaimer

Unless a written warranty is expressly provided:

• Merc Auto Center disclaims all warranties, express or implied.

• This includes implied warranties of merchantability and fitness for a particular purpose.

Any extended warranty or service contract is governed solely by its own terms and conditions.

 

8. Limitation of Liability

To the fullest extent permitted by law, Merc Auto Center shall not be liable for:

• Indirect damages

• Consequential damages

• Incidental damages

• Lost profits

• Loss of use of a vehicle

Our total liability shall not exceed the amount paid by the customer for the applicable product or service.

 

9. Customer Responsibilities

Customers agree to:

• Provide accurate information.

• Maintain required insurance coverage.

• Comply with all financing obligations.

• Inspect purchased vehicles before acceptance.

• Follow manufacturer maintenance recommendations.

 

10. Website Use

Any disputes arising under these Terms shall be resolved in the courts located in the State of Florida.

 

13. Dispute Resolution

Before initiating legal action, the parties agree to attempt good-faith negotiation to resolve any dispute.

If a resolution cannot be reached, disputes may be submitted to mediation before litigation where permitted by law.

 

14. Force Majeure

Merc Auto Center shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including:

• Natural disasters

• Government actions

• Supply chain disruptions

• Labor disputes

• Power outages

• Severe weather conditions

 

15. Modification of Terms
